\nJustice Kurian Joseph, one of the four senior-most Supreme Court judges, who virtually revolted against the country\u2019s Chief Justice over \u201cselective\u201d case allocation and certain judicial orders, on Saturday said there was no need for outside intervention to solve the problem.<\/p>\n
A day after he and the three other judges took the unprecedented step of addressing a press conference, Justice Joseph expressed confidence that the issues raised by them would be resolved,<\/p>\n
\u201cAn issue was raised. Those concerned have listened to it. Such actions would not occur in future. So (I) believe that the issue has been settled,\u201d he told reporters here when asked about ways to sort out the issues raised by them.<\/p>\n
\u201cThere is no need for outside intervention to solve the matter because it is a matter (that) occurred within an institution. Necessary steps would be taken by the institution itself to sort it out,\u201d Justice Joseph said, when asked if outside intervention was required to solve the matter.<\/p>\n
The matter was not brought to the attention of the President of India as he has no constitutional responsibility over the Supreme Court or the judges of the apex court, Justice Joseph said.<\/p>\n
He said there was no constitutional lapse on the part of Chief Justice of India but convention, practice and procedure have to be followed while carrying out his responsibility.<\/p>\n
\u201cWe just brought that matter to his attention,\u201d he said on the sidelines of the silver jubilee celebrations of the Major Archiespicopal Status of the Syro-Malabar Church at Kakkanad near here.<\/p>\n
Justice Joseph said the judges acted solely in the interest of judiciary and justice.<\/p>\n
\u201cAs some of you suggested it was a step for correction. The issue will end with the correction,\u201d he said.<\/p>\n
Earlier, he rejected suggestions that they had violated discipline and expressed the hope that their action will bring in more transparency in the administration of the Supreme Court.<\/p>\n
\u201cStood up for justice and judiciary…That is what we said there (in New Delhi) yesterday. Nothing beyond that,\u201d Justice Joseph said in Malayalam when local television news channels approached him at his ancestral home in Kalady near here seeking his reaction on Friday\u2019s development.<\/p>\n
\u201cAn issue has come to attention. It will certainly be solved, since it has come to the attention,\u201d he told reporters.<\/p>\n
Justice Joseph said the judges had acted only to \u201cenhance the trust of the people in judiciary\u201d. The four senior most judges of the Supreme Court\u2014Justices J Chelameswar, Ranjan Gogoi, M B Lokur and Kurian Joseph\u2014had on Friday called a press conference in New Delhi and said the situation in the top court was \u201cnot in order\u201d and many \u201cless than desirable\u201d things have taken place.<\/p>\n
Unless this institution is preserved, \u201cdemocracy will not survive in this country,\u201d they had said.<\/p>\n
Justice Chelameswar, the second senior judge after the Chief Justice of India, had said \u201csometimes administration of the Supreme Court is not in order and many things which are less than desirable have happened in the last few months\u201d.<\/p>\n","protected":false},"excerpt":{"rendered":"
