\nAt least two senior Supreme Court judges on Monday raised with Chief Justice of India Dipak Misra the issue of altering the seniority of Justice KM Joseph, who is scheduled to take oath as a top court judge on Tuesday along with Justice Indira Banerjee and Justice Vineet Sharan.<\/p>\n
Justice Madan B Lokur and Justice Kurian Joseph who also happen to be members of the Supreme Court collegium raised the issue with CJI Misra during the morning tea in the judges\u2019 lounge before going to their respective courts, sources said.<\/p>\n
The CJI told the senior judges that he would consult Justice Ranjan Gogoi, the seniormost judge after the CJI. Justice Gogoi, who is likely to replace CJI Misra in less than two months, was on leave on Monday. After the judges met him, the CJI consulted Attorney General KK Venugopal, sources said.<\/p>\n
The CJI is scheduled to administer oath to the three judges on Tuesday, taking strength of the Supreme Court to 25 against the sanctioned strength of 31 judges. According to the January 10 resolution of the collegium that recommended Justice Joseph\u2019s name for elevation to the top court for the first time, he was at serial number 45 in the combined seniority of High Court judges on an all-India basis. After taking oath as a top court judge, he will retire on June 16, 2023.<\/p>\n
Justice Banerjee was at serial number 4 while Justice Saran stood at serial number 5 in the combined seniority of HC judges, stated the July 16 resolution of the collegium which recommended their names for elevation.<\/p>\n
Justice Banerjee would retire on September 23, 2022 and Justice Saran on May 10, 2022. However, sources said some senior judges were upset at undermining of the \u201cseniority\u201d of Justice Joseph as his name was originally recommended by the collegium on January 10 along with that of senior advocate Indu Malhotra more than six months before the other two judges got recommended for elevation.<\/p>\n","protected":false},"excerpt":{"rendered":"
