{"id":50577,"date":"2018-12-20T11:27:40","date_gmt":"2018-12-20T11:27:40","guid":{"rendered":"http:\/\/blastingskyhawk.com\/?p=50577"},"modified":"2018-12-20T11:27:40","modified_gmt":"2018-12-20T11:27:40","slug":"brazils-lula-stays-in-prison-as-top-judges-tussle-over-release","status":"publish","type":"post","link":"https:\/\/blastingskyhawk.com\/english\/brazils-lula-stays-in-prison-as-top-judges-tussle-over-release\/","title":{"rendered":"Brazil\u2019s Lula stays in prison as top judges tussle over release"},"content":{"rendered":"<p>Brasilia<br \/>\nBrazil\u2019s leftist former president Luiz Inacio Lula da Silva remained in prison as two supreme court judges issued competing orders over whether he should be released while he tries to get his graft conviction overturned.<\/p>\n<p>Lula, 73, was given unexpected hope earlier Wednesday when one of the judges, Marco Aurelio Mello, went against a 2016 decision by the full supreme court to say all nonviolent prisoners who had lost an initial appeal could be provisionally freed to challenge their convictions.<\/p>\n<p>That would have included Lula, who lost a first appeal and since April has been serving a 12-year sentence for accepting a bribe from a big Brazilian construction company in the form of a seaside apartment.<\/p>\n<p>But hours later, as Lula\u2019s lawyers scrambled to have the bombshell order applied for their client, the chief justice of the supreme court, Jose Antonio Dias Toffoli, suspended Mello\u2019s order.<\/p>\n<p>Mello argued that his order could only be overturned by the full, 11-judge court, which had already scheduled an April 10, 2019 hearing to re-examine its 2016 ruling.<\/p>\n<p>But Dias Toffoli\u2019s decision backed the public prosecutor\u2019s office, which argued that Mello\u2019s order was invalid unless endorsed by the full court and published in the electronic version of the official judicial journal.<\/p>\n<p>The wrangling is sure to sow confusion just before Brazil\u2019s next president, Jair Bolsonaro, takes power on January 1.<\/p>\n<p>Lula\u2019s imprisonment prevented him from contesting October elections that were won by Bolsonaro, who lambasted the former leader and repeatedly tied Lula\u2019s Workers Party to corruption.According to the state news agency Agencia Brasil, up to 169,000 prisoners in Brazil could have been released under Mello\u2019s order.<\/p>\n<p>A prosecutor who was key in sending Lula to prison, Deltan Dallagnol, told reporters before the suspension that he believed Mello\u2019s decision was \u201ccompletely wrong\u201d and would be reversed.<\/p>\n<p>Lula, who is being held in a prison in the southern city of Curitiba, has said the charges against him and his incarceration were meant to keep him out of this year\u2019s election. He insists he is innocent of all the charges.<\/p>\n<p>During his two terms at the helm of Latin America\u2019s biggest economy, Lula rode high on Brazil\u2019s good fortune being a major commodity exporter as China\u2019s appetite for its resources expanded.
