The Madras High Court has observed that the employees of Reserve Bank of India cannot be referred to as “government servants” while identifying their employment status.<\/p>\n\n\n\n
The Division Bench, comprising of \nJustice KK Sasidharan and Justice PD Audikesavulu, said: “The fact that \nthe central government has persuasive control over RBI would not make \nits employees central government employees…\u201d “It is true that the RBI \nis a state within the meaning of Article 12 of the Constitution of \nIndia. Even then it cannot be said that its employees are all regular \nGovernment employees.”<\/p>\n\n\n\n
While filling up the questionnaire in the \napplication form for Combined Civil Services-I Examination, Kumar had \nidentified himself as a non-government employee in 2016.The Commission \nwithheld his result on the ground of suppression of material particulars\n in the application form regarding his employment with the Reserve Bank \nof India.”Are you a Government employee?” was one of the queries in the \nquestionnaire published by the TNPSC. Kumar answered it in the negative.<\/p>\n\n\n\n
However,\n his appointment met with a road block, and when he moved the court, a \nsingle bench at the Madras High Court dismissed his plea citing that the\n instruction on the application was very clear.<\/p>\n\n\n\n
The instructions \nto the candidates contained not only government service, but there was \nalso a provision to declare other services. It said that non-disclosure \nof the bank service is equivalent to suppression of information \nattracting disqualification.<\/p>\n\n\n\n
The Division Bench though observed \nthat the application form did not have a separate column clearly \nindicating the candidates to declare their nature of employment. Taking a\n contrary view on Kumar’s plea, it observed that the column in the \napplication form contained only one service for disclosure viz., \n“Government Service”, and thus it would not be possible for a Bank \nemployee to record that he is a Government employee.\n\n<\/p>\n","protected":false},"excerpt":{"rendered":"
