Amid allegations of conspiracy to frame Chief Justice of India Ranjan Gogoi in a sexual harassment case, the Supreme Court on Wednesday asserted that it will get to the bottom of the matter and take it to its logical conclusion. <\/p>\n\n\n\n
A three-judge Bench of Justice Arun Mishra, Justice \nRohinton F Nariman and Justice Deepak Gupta which had sought presence of\n CBI Director, Intelligence Bureau Director and Delhi Police \nCommissioner for in-chamber interaction asked them to seize the relevant\n material in order to support the claims made in an affidavit filed by \nadvocate Utsav Bains. <\/p>\n\n\n\n
These top officials were called at 12.30 \npm after the pre-lunch proceedings in the case and the Bench \nre-assembled at 3 pm to hear the matter again when Bains placed \nsubmitted an envelope containing some papers to substantiate his claims.\n <\/p>\n\n\n\n
Noting that “very disturbing” facts had emerged, the Bench said\n it concerned independence of judiciary and the claims made by Bains \nneeded to be gone into. <\/p>\n\n\n\n
\u201cHe has said that there are fixers. Who \nare these fixers? We need to find out these fixers manipulating the \njudiciary. If they continue to work then none of us will survive Fixing \nhas no role to play in the system. We will inquire and inquire and \ninquire and take it to logical conclusion,\u201d the Bench said. <\/p>\n\n\n\n
Bains\n had claimed that he was offered Rs 1.5 crore by one Ajay to represent a\n former top court woman employee and arrange a press conference against \nthe CJI at the Press Club of India in the capital. He, however, did not \ndisclose his source of information. He had alleged that disgruntled top \ncourt employees Tapan Kumar Chakraborty and Manav Sharma and others had \nganged together in frame the CJI in a sexual harassment case after their\n dismissal.<\/p>\n\n\n\n
As Bains said he would like to file another affidavit\n giving further “incriminating evidence”, the Bench asked him to do it \nby 10.30 am on Thursday when it will take up the matter again. <\/p>\n\n\n\n
\u201cConsidering\n the seriousness of the allegations as the system has absolutely no \nplace for such fixers, we cannot leave the matter at that. It becomes \nour responsibility to keep this Institution clean as well as to ensure \nthat the image of this Institution is not tarnished by such allegations \nto undertake the probe in the matter,\u201d the Bench said in its order. <\/p>\n\n\n\n
But\n it turned down request made by Attorney General KK Venugopal and \nSolicitor General Tushar Mehta for a court-monitored SIT probe at this \nstage. The Bench clarified that there was no connection between the \nhearing on allegations of conspiracy and an in-house inquiry into the \nsexual harassment allegations against the CJI. <\/p>\n\n\n\n
The hearing \nwitnesses some heated exchange between Bains and Venugopal after the \nformer said some of his information was privileged that he didn\u2019t want \nto disclose. \u201cI really don\u2019t understand how a person can make certain \nallegations and claim rest is privileged,\u201d the Attorney General said, \nprompting Bains to react. <\/p>\n\n\n\n
As Bains was responding to Venugopal, \nJustice Nariman told Bains: \u201cYou have no reason to have an iota of doubt\n on him. He is the most respected member of this Bar. We all look up to \nhim. If you have an iota of doubt, we will throw you out\u201d. <\/p>\n\n\n\n
Senior\n advocate Indira Jaising who appeared in her personal capacity alleged \nthat Bains came inside Supreme Court premises in a car without a \nsticker. \u201cHow can he do that?
