The Supreme Court will on Friday take up fugitive economic offender Vijay Mallya’s petition challenging confiscation of properties belonging to companies owned by him and his family members.

On January 5, a special PMLA court in Delhi had declared Mallya a fugitive economic offender and commenced proceedings for confiscation of his properties. Mallya, who is currently in the UK, has been charged by the Enforcement Directorate with defaulting on bank loans to the tune of Rs9,000 crore. He is facing an extradition trial in the UK at the instance of Indian authorities.

A Bench headed by Chief Justice Ranjan Gogoi today agreed to take up Mallya’s plea on August 2 after senior counsel Fali S Nariman, representing Mallya, submitted that his petition be heard along with another petition already pending on the legality of the law and the order to confiscate the properties.
Mallya had approached the top court on June 27 seeking a stay on the confiscation of properties owned by him and his relatives, saying no other properties other than that of Kingfisher Airlines facing cases of alleged irregularities should be attached.

The Bombay High Court had refused to grant stay on proceedings before a special court on confiscation of Mallya’s properties. In June, a division Bench of the court had dismissed Mallya’s plea for stay on the proceedings before the special court hearing cases under the Prevention of Money Laundering Act .
